Terms and conditions of use

SOS Nursing Marrakech (hereinafter 'SOS Nursing' or 'the Company') is a limited liability company under Moroccan law specialising in the coordination and provision of home nursing care in the Marrakech-Safi region.

In these terms: 'Platform' means the website sosinfirmier.com and any associated application; 'User' or 'Patient' means any individual using the services or browsing the Platform; 'Family' means the relatives or legal representatives of the Patient; 'Nurse' means a state-registered nurse employed or mandated by SOS Nursing; 'Services' means all nursing care and coordination services offered by SOS Nursing.

These terms define the conditions of access to and use of the Platform, as well as the respective rights and obligations of SOS Nursing and the User in the context of home nursing care.

They apply to all access to and use of the Platform, whether the User is a Patient, Family member or simple visitor. Use of the Platform constitutes full and unreserved acceptance of these terms.

Access to the Platform is free and open to anyone with internet access. Creating an account is required to benefit from certain features (visit tracking, patient file, messaging).

SOS Nursing reserves the right to temporarily suspend or restrict access to the Platform for maintenance, updates or security reasons, without this giving rise to any compensation.

SOS Nursing offers the following services: home nursing care (injections, dressings, infusions, catheter placement, post-operative care), vital signs monitoring and clinical surveillance, biological sample collection and laboratory transport, home palliative care and support, care coordination with the treating physician, and digital clinical follow-up via the Platform.

SOS Nursing is a nursing care coordination service. It directly employs its nurses and ensures the quality of care through rigorous clinical supervision. SOS Nursing is not a healthcare facility and does not provide medical consultations.

Care requests can be made via the Platform, by telephone or by WhatsApp. Each request is assessed by our coordination team, who verify feasibility and propose an appointment slot.

A detailed quote is provided to the Patient or their Family before any intervention. Confirmation of the appointment constitutes acceptance of the quote. For recurring care, a schedule is agreed upon mutually.

SOS Nursing undertakes to confirm nurse availability within a reasonable time. No care is provided without prior validation by our coordination team.

Service rates are communicated before any intervention in the personalised quote. They are expressed in Moroccan dirhams (MAD), inclusive of all applicable taxes.

Payment is due after completion of each visit, unless otherwise agreed for periodic billing. No deposit is required. Accepted payment methods include: cash, bank card, bank transfer and mobile payment.

In the event of a payment delay exceeding 30 days, SOS Nursing reserves the right to suspend services after formal notice has been given and has remained without effect, except in cases of clinical emergency.

Cancellation or rescheduling of an appointment is free up to 4 hours before the scheduled time. Beyond this deadline, a flat-rate coordination fee may be charged.

In the event of cancellation by SOS Nursing (nurse unavailability, force majeure), we undertake to offer a replacement slot as soon as possible or to cancel without any charge.

The Patient and their Family undertake to: provide accurate and complete information about the Patient's clinical situation (medical history, allergies, current treatments), provide the original medical prescriptions necessary for the delivery of care, ensure a clean and safe environment for the delivery of care at home, report any change in the Patient's health status between visits, and respect agreed schedules.

The Patient or their legal representative is free to refuse care at any time. In such cases, the nurse will document the refusal and inform the coordination team.

SOS Nursing undertakes to: verify the qualifications, diplomas and practice authorisations of every nurse before any assignment, ensure effective coordination between the Patient, the Nurse and the treating physician, document each visit in a detailed care report accessible via the Platform, guarantee the confidentiality of personal and health data in accordance with our privacy policy, and maintain professional liability insurance covering all its activities.

SOS Nursing implements a continuous quality programme including clinical supervision, ongoing nurse training, and patient satisfaction surveys.

SOS Nursing Marrakech is a home nursing care service. It does not in any way replace the treating physician, specialist doctor or any other healthcare professional authorised to make a medical diagnosis or prescribe treatment.

The information provided on the Platform is for informational purposes only and does not constitute medical advice. If you have any concerns about your health, consult your treating physician.

SOS Nursing is not a life-threatening emergency service. In the event of a medical emergency threatening the patient's life, immediately contact SAMU on 141 or the fire brigade on 15.

SOS Nursing makes every effort to ensure the quality and safety of care. However, SOS Nursing's liability shall not be engaged in the following cases: inaccurate or incomplete clinical information provided by the Patient or their Family, refusal of care by the Patient, temporary unavailability of the Platform due to maintenance or force majeure, and consequences arising from the Patient's failure to follow the Nurse's recommendations.

SOS Nursing's liability under these terms is limited to the amount of services actually invoiced during the preceding 12 months.

All elements constituting the Platform (texts, images, logos, trademarks, software, architecture, design) are the exclusive property of SOS Nursing Marrakech or are used under licence.

Any reproduction, representation, modification or exploitation, in whole or in part, of these elements without the prior written authorisation of SOS Nursing is strictly prohibited and constitutes infringement punishable under Moroccan intellectual property law (Law 2-00).

The processing of Users' personal data is governed by our Privacy Policy, accessible on the Platform at /privacy. This policy forms an integral part of these terms.

By using our services, you acknowledge that you have read our Privacy Policy and accept the processing arrangements described therein.

SOS Nursing shall not be held liable for failure to perform or delay in performing its obligations in the event of force majeure within the meaning of Article 269 of the Moroccan Code of Obligations and Contracts, including: natural disasters, epidemics, pandemics, strikes, armed conflicts, government decisions, or telecommunications network failures.

In the event of force majeure persisting beyond 30 days, either party may terminate the contract by right upon written notice.

The User may stop using the Platform and our services at any time. Account deletion can be requested by contacting our coordination team.

SOS Nursing reserves the right to suspend or terminate a User's access in the event of a serious breach of these terms, conduct threatening the safety of nurses, or persistent non-payment after formal notice.

These terms are governed by Moroccan law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action.

Failing amicable settlement within 30 days, any dispute relating to the interpretation or performance of these terms shall be submitted to the exclusive jurisdiction of the courts of Marrakech, Kingdom of Morocco.

If any clause of these terms is declared null or unenforceable, the remaining clauses shall retain their full validity and effect.

Failure by SOS Nursing to exercise a right under these terms does not constitute a waiver of that right. These terms constitute the entire agreement between the User and SOS Nursing regarding the use of the Platform and services.
